Terms of Service

Welcome to CueUp. These Terms of Service ("Terms") govern your use of the CueUp mobile application, kiosk, and website (collectively, the "Service") provided by KT Enterprise ("CueUp," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CueUp is a queue management and appointment booking platform for barbershops and beauty salons. Customers can join walk-in queues, book appointments, view real-time status, and receive notifications. Providers (barbers, stylists, and shop owners) can manage their queue, services, schedule, and client communications.

2. Eligibility & Accounts

You must be at least 13 years old to use CueUp. If you are under 18, you must have permission from a parent or legal guardian. You agree to provide accurate, current information when creating your account and to keep your login credentials secure. You are responsible for all activity on your account.

3. Provider Subscriptions

Providers and shop owners may purchase paid subscriptions to access provider features. Plans currently available are Solo ($19.99/month), Pro ($39.99/month), and Shop ($79.99/month). New subscribers get a 14-day free trial. Subscriptions are processed through Apple in-app purchase (on iOS) or Google Play billing (on Android) and automatically renew monthly unless cancelled. Trial converts to a paid subscription unless cancelled at least 24 hours before the trial ends. You can cancel at any time from your device's subscription settings; cancellation takes effect at the end of the current billing period. Trial users who do not subscribe lose access to provider features after the trial ends.

4. Customer Use

The Service is free for customers. Joining a queue or booking an appointment is a request to a participating shop, not a guaranteed reservation. Shops may turn away customers, change their queue, or cancel appointments at their discretion. CueUp is not a party to the transaction between you and any shop and is not responsible for the quality of services provided.

5. SMS Program Terms

The following terms govern the CueUp SMS notification program. By providing your mobile phone number and checking the SMS consent box during signup or kiosk registration, you provide express written consent to these SMS Program Terms.

Opt-Out Instructions
Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE) to any message to unsubscribe at any time. You will receive one confirmation message and no further texts.

Major U.S. carriers including AT&T, Verizon, T-Mobile, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages.

How to Opt In

You can opt in to the CueUp SMS program in two ways, both of which require your express written consent via an unchecked checkbox that you must affirmatively tick:

  1. In-app signup: When creating an account in the CueUp mobile app, enter a phone number and tick the SMS consent checkbox before tapping "Create Account."
  2. In-shop kiosk: When joining a queue at a participating shop's kiosk, enter a phone number and tick the SMS consent checkbox before tapping "Sign In."

You may also reply START, YES, or UNSTOP to a CueUp number after previously opting out to re-enroll.

How to Opt Out

You may opt out of CueUp SMS at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE) to any message we send. After opting out, you will receive one final confirmation message and will not receive any further messages from CueUp. You can also disable SMS notifications from within your CueUp account settings. Opting out of SMS does not affect your ability to continue using the CueUp app.

Privacy

We do not share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. Mobile information is used only to deliver the SMS notifications you have opted in to receive, and is shared only with our SMS infrastructure provider (Twilio) for the sole purpose of delivering those messages. You retain ownership of content you submit (photos, reviews, messages). By submitting content, you grant CueUp a worldwide, non-exclusive, royalty-free license to host, display, and use that content in connection with operating the Service. You are responsible for the content you submit and represent that you have the right to submit it.

8. Intellectual Property

CueUp, the CueUp logo, the tagline "Where Style Gets Scheduled," and all related marks are the property of KT Enterprise. The Service, including its design, code, and content (other than user content), is protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. CueUp does not endorse any shop or provider listed in the Service and is not responsible for the conduct, quality of service, pricing, or business practices of any shop.

10. Limitation of Liability

To the maximum extent permitted by law, CueUp and KT Enterprise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability for any claim shall not exceed the amount you paid to CueUp in the 12 months preceding the claim, or $100, whichever is greater.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion. You may delete your account at any time from within the app. Upon termination, your right to use the Service ends immediately.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Dallas County, Texas.
